After completing a qualifying purchase, participants will receive a promotional code redeemable for one (1) 30 ounce tumbler (Approximate Retail Value: $39.99), while supplies last (“Promotional Code”). Promotional Code will be sent to the e-mail address provided during checkout within seven (7) days of completing the qualifying purchase. How to Redeem Your Tumbler: After obtaining the Promotional Code, visit hjgradshop.com by or before 11:59:59 PM ET on 12/31/22 (the “Code Redemption Expiration Date”), and follow the instructions to receive one (1) the tumbler. Sponsor reserves the right to substitute the tumbler with a premium of equal or greater value. Any taxes, fees, and other related costs incurred in conjunction with redeeming and/or shipping the tumbler are the sole responsibility of the recipient unless otherwise provided in writing by Sponsor. Release and Waiver of Liability: By redeeming this Offer, individuals agree to release, defend, indemnify and hold harmless the Sponsor, Hercules Achievement, Inc., and each of their respective parent corporations, subsidiaries, advertising and promotion agencies, affiliates, directors, officers, employees, representatives and agents (collectively “Released Parties”) from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with (i) participant’s participation in the Offer; and (ii) the receipt, use or misuse of the tumbler or substitution by Sponsor thereof, or while preparing for, participating in, and/or traveling to any Offer-related activity. Construction/Disputes: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of any individual or the Sponsor, shall be governed by, and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions (whether of Texas, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Texas. The parties agree that all disputes arising out of or connected with these Terms and Conditions or the Offer will be resolved individually, and without resort to class action.

DISCLAIMER OF WARRANTIES/LIMITATION OF LIABILITY: THE SPONSOR IS NOT RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE OFFER, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Sponsor assumes no responsibility for damage caused by computer virus or otherwise, to any computer resulting from participant’s access of the Offer website or participation in the Offer.
